Responsibility of ASPRO

ASPRO shall only be liable for damages that the User may suffer as a result of using the Website when such damages are directly attributable to willful misconduct by the company. The User acknowledges and agrees that the use of the Website, as well as the provision of the services offered therein, is carried out under their sole responsibility and at their own risk.

ASPRO shall not be liable for any damages that may result from, including but not limited to:

  1. Interferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational functioning of this electronic system or the Users’ devices or IT equipment, caused by reasons beyond ASPRO’s control, that prevent or delay the provision of services or navigation through the system.
  2. Delays or blockages in use caused by Internet deficiencies or overloads or in other electronic systems.
  3. Any damages caused by third parties through unauthorized intrusions beyond ASPRO’s control.
  4. Inability to provide the service or allow access due to causes not attributable to ASPRO, the User, or third parties, or due to force majeure or unforeseeable circumstances.

ASPRO does not generally control the use that Users make of the Website. In particular, ASPRO does not guarantee under any circumstance that Users use the Website in accordance with the law, these General Terms of Use, morality and generally accepted good practices, or public order, nor that they use it in a diligent and prudent manner.

ASPRO does not guarantee the availability and continuity of the Website’s operation. Likewise, ASPRO does not guarantee the usefulness of the Website or its contents for any specific activity. ASPRO excludes any liability for damages of any kind that may be due to the lack of availability or continuity of the Portal’s operation or to the disappointment of the usefulness that Users may have attributed to the Portal.

ASPRO ensures that it has appropriate measures that meet the security standards currently available in technology.

Intellectual Property

All rights over the content of this Website belong to ASPRO OCIO, S.A.

The design, images, animations, videos, maps, graphics, frames, banners, software and its different source and object codes, and other elements forming part of this Website are the exclusive property of ASPRO OCIO, which legitimately holds the exploitation rights over them.

Consequently, any user accessing this Website may not under any circumstances copy, modify, distribute, reproduce, publish, license, transfer, sell, or otherwise transmit them, nor create new products or services based on the information and elements contained herein. Only viewing and downloading for the user’s personal and non-commercial use is authorized, and it cannot be extended to third parties or entities.

In the case of designs, images, animations, videos, maps, graphics, frames, banners, software and its different source and object codes that appear on this Website and are owned by ASPRO OCIO’s partner companies or entities, the same conditions and protections shall apply, unless expressly and in writing agreed otherwise by such companies or entities.

ASPRO OCIO will ensure that the content of this Website is not pornographic, xenophobic, discriminatory, racist, defamatory or otherwise violent or unlawful, and will work to prevent anomalies or illicit activities on the Internet and avoid circumstances clearly harmful to users.

Any technological or technical resource that allows third parties or users to benefit, with or without profit, from the content, forms, indices, and other formal expressions forming part of this Website is prohibited. In particular, any alteration of the Website that may affect its content or any other unauthorized intrusion is strictly forbidden.

Personal Data Protection Policy: Processing of Collected Personal Data

The personal data that the User provides during the purchase process or when requesting services offered on the Portal, as well as any other data generated later as a result of their relationship with us, will be included in files managed by the company that owns the leisure park whose ticket the User has purchased or whose services, promotions, surveys, or games they request (whose information is detailed in the “ASPRO Group Entities” section), together with its parent company ASPRO OCIO S.A.U. (registered office at Recinto del Parque de Atracciones, Calle Oquendo 23, 28006 Madrid, Spain; email: marketing@aspro-ocio.es), who are jointly responsible for processing the data (the “Controllers”).

The data will be processed to manage, maintain, and control the relationship with us, and particularly for park ticket management, service provision requested by the User, or their participation in promotions, surveys, or games for which the data was provided. Data may also be used to respond to User requests, preserve communications to improve our service, and for statistical purposes.

Unless the User checks the box included in the data collection form, they authorize the Controllers to use their data to carry out surveys, and send advertising, promotional communications, and consumer research by any means (including electronic communication or fax), relating to leisure sector products or services (e.g., amusement parks or hotel sector). This authorization includes the ability of the Controllers or third parties (who will not receive your data from the Controllers) to determine the target audience parameters for these campaigns.

To exercise your rights of access, rectification, erasure, and objection under applicable law, the User must send a written request to the Controllers to the address or email provided in this clause, indicating in the subject line “Request – Marketing Department” and attaching a copy of a document proving their identity.

Under 14 years of age

IF THE USER IS UNDER 14 YEARS OLD, PARENTAL CONSENT IS REQUIRED. We will contact the parents or guardians to confirm their relationship and obtain consent before processing the request.

However, ASPRO OCIO assumes no responsibility for the products sold or services provided by such companies, nor for the content of their websites, nor for the proper and timely fulfillment of such services or contracts. ASPRO OCIO cannot control nor be held responsible for whether the partner companies comply with their legal obligations.

Applicable Law and Jurisdiction

These General Terms of Use shall be governed by Spanish law, which shall apply in all matters not expressly covered by this agreement with regard to its interpretation, validity, and enforcement.

The parties submit to the courts and tribunals that may be legally competent to resolve any dispute that may arise regarding the interpretation or enforcement of these terms.
